In those cases in which under the leases the lessees are bound to repair and make good the damage no claim is made by Mr Burgoyne in respect of the damage to be so made good; but only in respect of the depreciation in letting value of the reversionary interests and reversionary damage to water rights and mill rights in connection with them, by reason of injury to the bed of the stream or the river Loxley and by the flow and fall of the water being otherwise altered and prejudicially affected and for other reversionary damage. The claim of Mr Burgoyne includes all temporary and immediate damage to himself including any loss of rent, payments to Police for special protection of property, etc. |
